About the Job
Capagility Pty Ltd is looking to employ an outstanding commercial practitioner to join its team of specialists, as a Commercial Consultant to Defence and civilian clients, mainly in the aerospace domain. The ideal candidate is highly knowledgeable and experienced in complex procurement and contracting and desirably has experience working in an Australian Defence environment. The consultant will be well-versed in promoting and applying commercial best practice to deliver excellent commercial outcomes for Capagility’s Defence and civil sector clients, including by:

identifying and helping to mitigate commercial and financial risks;
-
delivering value-for-money outcomes and minimising through-life cost of ownership;
-
reducing the costs of tendering for both the customer and potential suppliers;
-
minimising procurement and contract management, governance, and administration;
-
fostering healthy and respectful relationships between customers and suppliers; and
-
employing contemporary performance management.
The Commercial Consultant will provide detailed expert support and advice in relation to a wide range of complex procurement and contracting activities, primarily in the Australian Defence environment. The Commercial Consultant may be required to:
-
assess supplier market trends including current and future market capacity and capability;
-
design and develop acquisition/procurement strategies, including analysis of potential contracting models and commercial arrangements;
-
develop procurement plans and business cases;
-
design and develop contract performance management frameworks;
-
develop draft contracts and approaches to market (such as requests for tender);
-
perform commercial liability risk assessments;
-
lead, or assist with, tender evaluation activities, and providing expert advice to Defence during those activities;
-
support, and advise on, contract negotiations;
-
develop procurement approval submissions;
-
advise on contract management and administration issues; and
-
conduct training and education for Defence personnel in relation to procurement methodologies, contracting options and contracting processes.
Essential Criteria
-
A qualified commercial practitioner with relevant tertiary qualifications and substantial relevant experience.
-
At least 8 years of experience in the field of commercial contracts development and management, with at least a portion of that time working in an Australia Defence procurement and contracting context, including significant experience and knowledge in at least several of the following areas:
-
Coordination or management of complex procurement projects;
-
Development of procurement strategies and plans;
-
Application of different procurement and contracting methodologies/models;
-
Assessing commercial risk;
-
Participation in tender evaluations;
-
Support for, or involvement in, contract negotiations (including negotiation strategy development);
-
Production of procurement process artefacts (eg tender evaluation reports, source/supplier selection reports, negotiation reports, contract approval submissions); and
-
Management of contracts.

Australian Citizen and is authorised to work in Australia.

Currently holds, or is eligible for, a Negative Vetting 1 (NV1) Security Clearance through the Australian Government Security Vetting Agency (AGSVA).
Desirable Criteria
-
Tertiary qualifications (preferably Masters) in Law, Commerce, Business, or a related field.

Experience in applying and tailoring the ASDEFCON suite of templates for contracts relating to the acquisition or support of complex technical equipment.
-
Experience with development of draft contracts and requests for tender, including with the Australian Standard for Defence Contracting (ASDEFCON) suite of templates.
-
Experience in providing professional consulting or advisory services to client agencies.
-
Experience in commonwealth and Defence procurement and contracting policies and procedures.
-
Canberra based with the ability to complete the majority of work remotely.
